SMA DIGITAL BUSINESS LLC

Privacy Policy

Our approach to personal information, international data processing, and your privacy rights.

01Entity and scope

SMA DIGITAL BUSINESS LLC is a registered United States limited liability company and the entity responsible for personal information processed in connection with its corporate website and cross-border commerce operations. This policy applies to website visitors, customers, prospective partners, and people contacting our teams.

Offer-specific notices may supplement this policy. Independent payment processors and other providers may also apply their own privacy notices when they act as independent controllers.

02Information we collect

We may collect identification and contact data, including name, email, telephone number, delivery address, and communications you choose to provide. Transactional data may include order references, products or services ordered, delivery status, payment method, amounts, and payment confirmation records.

Payment metadata may include processor references, transaction status, and limited payment-method identifiers. Do not send full card numbers, security codes, passwords, or identity documents by ordinary email. Payment credentials submitted to a processor are governed by that processor’s security and privacy practices.

Device and browser information may include IP address, browser type, operating system, timestamps, and technical logs. Cookies or similar technologies may support necessary site functions; where nonessential analytics or advertising technologies are used, consent is sought where required by applicable law.

03How and why we use information

Information is used to verify transactions, confirm orders, arrange fulfillment, deliver digital access, respond to questions, prevent fraud and abuse, maintain service security, and meet accounting or regulatory obligations.

Where a legal basis is required, processing is based on performance of a contract, compliance with legal obligations, legitimate interests subject to applicable safeguards, or consent. Optional marketing communications are subject to applicable consent and opt-out requirements; withdrawing consent does not affect earlier lawful processing.

04Sharing and third-party providers

Relevant information may be shared with vetted local logistics partners for delivery and settlement, payment processors for transaction handling and fraud checks, and customer communication or technology providers supporting our operations. Information shared is limited to what is needed for the relevant purpose.

Providers acting on our behalf are expected to process information under appropriate contractual restrictions. Disclosure may also occur where legally required, to protect rights and safety, or in a corporate transaction subject to applicable privacy safeguards.

05Cross-border transfers

Our operations span the United States, Latin America, and Europe. Information may be processed in jurisdictions with different data protection laws. Where required, transfers are subject to legally recognized safeguards, such as appropriate contractual protections or other permitted transfer mechanisms.

For details about safeguards applicable to your information, contact our privacy team. This policy does not waive protections granted by the law applicable to you.

06Retention

Information is retained only as needed for the purposes described, including completing orders, resolving disputes, preventing fraud, and satisfying legal, tax, or accounting obligations. Retention varies by data category and applicable jurisdiction; information is deleted or de-identified when no longer needed, subject to lawful preservation duties.

07Security safeguards and encryption

We use reasonable organizational and technical safeguards appropriate to the information and processing risks, including access restrictions and secure transmission where supported. Encryption and payment-security controls depend on the relevant systems and processors; this policy is not a certification of a particular security standard.

No transmission or storage method is completely secure. If you suspect misuse of your information or an account, contact support promptly without including sensitive payment credentials.

08Your rights and choices

Depending on applicable law, you may request access, correction, erasure, restriction, portability, or objection to processing, and opt out of eligible marketing communications. You may withdraw consent where processing relies on it and lodge a complaint with a competent data protection authority.

Send requests to privacy@sma-digital.com. We may need proportionate identity verification before acting. Rights are subject to lawful exceptions, and requests are handled within the period required by the applicable jurisdiction.

09Children and policy changes

Our corporate website is not directed at children. If you believe a child has provided personal information without appropriate authorization, contact us to request review. We may revise this policy as practices or legal requirements change; material changes are communicated where required.
