SMA DIGITAL BUSINESS LLC
Terms of Service
The commercial conditions and responsibilities that apply to our website and commerce services.
01Acceptance and entity
These Terms govern use of the corporate website and applicable services of SMA DIGITAL BUSINESS LLC, a registered United States limited liability company. By using the website or placing an order, you agree to the terms disclosed to you. If you do not agree, do not use the service or place an order.
Specific offer, checkout, delivery, cancellation, or refund conditions disclosed before purchase supplement these Terms. Mandatory consumer protections apply regardless of these Terms.
02Scope of services
We operate direct-to-consumer physical commerce through cash-on-delivery and after-pay models, with no held inventory and fulfillment coordinated through vetted local carriers and logistics partners. Availability depends on the offer and market.
We also operate multilingual, online-delivered digital products and services. Access, delivery format, compatibility, duration, and other offer conditions are disclosed at purchase. This corporate website is not itself a catalog or checkout.
03Order placement and verification
Provide accurate contact and delivery information and review the offer’s price, currency, applicable taxes or charges, and payment conditions before confirming. Orders may require verification through a customer care agent or the relevant checkout.
An inquiry does not create an accepted order. Acceptance and availability are confirmed through the relevant sales channel. We may decline or cancel an order for suspected fraud, invalid details, unavailable fulfillment, or legal restrictions, subject to applicable law and any required reimbursement.
04Delivery and payment
Physical delivery is arranged with local partners. Delivery estimates, coverage, charges, and payment timing are communicated for the specific order; delays may occur outside our reasonable control. Follow the verified instructions supplied for your order and contact support if a delivery attempt or payment instruction is unclear.
For cash-on-delivery, payment is due at the point specified in the confirmed delivery arrangement; for after-pay, the disclosed settlement conditions apply. Digital fulfillment follows payment verification and the access conditions disclosed at checkout. No universal delivery deadline or payment method is promised by these Terms.
05Cancellations, returns, and post-purchase rights
Cancellation, return, refund, and withdrawal rights depend on the offer and applicable local law. Relevant conditions must be disclosed before purchase and cannot override mandatory consumer rights, including rights relating to defective or undelivered products.
Contact support@sma-digital.com with your order reference to request assistance. Digital-content withdrawal exceptions apply only where legally permitted and required consent and acknowledgment have been obtained. These Terms do not impose a blanket no-refund policy.
06Intellectual property and acceptable use
Website content, brand assets, and proprietary materials belong to SMA DIGITAL BUSINESS LLC or their licensors. Any permitted digital access is for the use and scope stated in the relevant offer, not a transfer of ownership.
Do not copy, resell, distribute, circumvent access controls, infringe third-party rights, submit fraudulent orders, or disrupt our services without lawful authorization. Statutory exceptions remain unaffected.
07Disclaimers and limitation of liability
To the extent permitted by law, website information is provided without a promise of uninterrupted or error-free availability. We do not exclude statutory warranties or rights that cannot lawfully be excluded.
To the extent legally permitted, we are not liable for indirect or consequential losses arising from use of this corporate website. Nothing limits liability for fraud, willful misconduct, or any other liability that applicable law prohibits limiting. Offer-specific obligations and mandatory consumer remedies remain enforceable.
08Indemnification
To the extent permitted by applicable law, you are responsible for losses and reasonable costs resulting from your unlawful misuse of the services or infringement of third-party rights. This provision does not impose liability beyond what applicable law permits or shift our own legal responsibilities to you.
09Governing law and disputes
These Terms are governed by applicable United States law, subject to mandatory conflict-of-law rules and protections of your jurisdiction. Nothing deprives a consumer of non-waivable local rights or access to a competent court.
First contact legal@sma-digital.com to seek an informal resolution. If a dispute remains unresolved, it may be brought before a court with lawful jurisdiction. These Terms do not impose mandatory arbitration or waive collective or individual rights granted by law.
10Severability, changes, and legal notices
If a provision is held unenforceable, the remaining provisions continue to apply to the extent permitted by law. Changes apply prospectively; material changes are communicated where required and do not retroactively remove accrued rights.
